$14.25 million settlement during trial

This was a defective product case.  Our client was riding a motorcycle with a defective tire/inner tube.  The defect caused a tragic wreck, leaving the victim severely injured and permanently incapacitated.  This case involved multiple corporate defendants and took several years to complete. The trial was scheduled to last more than a month.  It settled soon after the trial began.  The case was reported at Virginia Lawyers Weekly, June 15, 2009, page 29; and February 1, 2010 (front page and listing of largest settlements of 2009 on page 7).  This was reportedly the largest settlement in Virginia that year.

$13.9 million jury verdict

This was a case against Wal-Mart.  A Wal-Mart employee left water on the floor but did not place any warning signs in the area.  The client slipped and fell, suffering severe orthopedic injuries to his back, shoulder and elbow causing permanent pain and disability.  After a three-day trial, the jury awarded $11.25 million plus prejudgment interest, for a total of more than $13.9 million.  This case was reported at Virginia Lawyers Weekly, May 20, 2013 and March 1, 2013.  This was reportedly the largest personal injury jury verdict ever in Stafford County.

This was a case against a convenience store chain, which failed to warn customers of a dangerous condition on its sidewalk that was not apparent to customers.  Our client fell as a result and suffered a traumatic brain injury. The jury returned its verdict after seven days of trial.  This case was reported at Virginia Lawyers Weekly, May 7, 2007 (front page); July 2, 2007; and January 14, 2008 (front page and listing of largest jury verdicts on page 5).  This was reportedly the largest personal injury jury verdict in Virginia that year.

Our client was riding in a car on the highway when a tractor-trailer rear-ended the car, sending it spinning and rolling. Our client had a prior history of brain injury and suffered additional brain injury. The trial took nine days; the jury returned its verdict on the tenth day.  This case was reported at Virginia Lawyers Weekly, August 11, 2008 (front page); and Virginia Lawyers Weekly list of largest verdicts of 2008.  This was reportedly the largest personal injury verdict in Virginia that year.

Our client was a child who was injured in a store when a merchandise display fell on her. She sustained skull fractures and a brain injury. This was a tragic wrongful death case in which two young children were struck and killed by a tractor-trailer.  The defendant trucking company and the defendant driver both denied responsibility.  They also claimed that the trucking company was not responsible because the driver was an independent contractor not employed by the trucking company.  After extensive litigation, the case settled for all of the insurance coverage available to both defendants.  Reported at Virginia Lawyers Weekly, May 4, 2020.  This was reportedly the second largest personal injury settlement in Virginia of the year.
